TERMS OF QUOTATION

1) Our quotations draw on the total availability of plants and materials and not just those we happen to have in stock at the time of this quotation. Therefore not all of the quoted items may be available at the time of approval. If desired, please contact us for current availability.

2) ALL REPLACEMENTS ARE PENDING AVAILABILITY FROM THE ORIGINAL QUOTED SOURCES. GUARANTEES ARE AS FOLLOWS:

Woody Ornamental 100% - 1 year from delivery.

Semi-woody & Perennials 100% - 90 days from delivery.

Spring Bulbs 90% - until July 1 of the following year when properly installed.

Repositioned plants NOT covered under any guarantee unless specified here within.

All guarantees may be voided if owner elects to have an automatic in-ground irrigation system establish non-lawn plants or repositions the plant following its original installation.

3) Our guarantees cover ONLY the products' and/or plants' original cost & supplier, with any increases being additional. Landscape Designs, Inc. must receive WRITTEN NOTICE of any difficulties, problems, repairs or replacements within our guarantee periods. Our guarantees do not cover plants damaged by acts of Nature, which are beyond our control. Our guarantees apply only when Landscape Designs, INC PROVIDES the products and/or plants. All guarantees are voided if payments are not made as specified.

4) Materials will be as specified. All installation work will be completed in a professional manner according to specifications submitted, per standard practices. Any ALTERATIONS or DEVIATIONS, from the quoted specifications, involving additional costs are executed at a charge over and above this quotation. IF the owner elects to change or modify this quotation's designated landscape installations, products and/or specifications, the owner is hereby informed that this quotation becomes a time and materials contract. All services performed, which are not included in this quotation, would be billed at the rate current to when the services are performed. Agreements are contingent upon strikes, accidents or delays beyond our control.

All contracted labor is covered by Workers' Compensation Insurance.

5) Washouts, beyond our control, of mulches, soils, and seed, are the responsibility of the owner and not the contracted landscaper, unless specified in this quotation.

6) Many plants, including very common ones, may cause physical intoxication or poisoning. Since reaction, to many of these intoxicants or poisons, is often individually specific, Landscape Designs, Inc. cannot be held liable for injury, potential or realized, due to the contact and/or ingestion of any designated plant. Please contact us for further information.

7) All locating and damages to PRIVATE irrigation, electrical, propane (LP) or other utility lines are the responsibilities of the owner. All COMMERCIAL service lines: gas, telephone, electric and TV cable, are marked by those service companies pursuant to the State of Wisconsin Statute section 182.0175.

8) NOTE: This quotation may be withdrawn by Landscape Designs, Inc. if not accepted within 30 days.
Previously signed and contracted work has precedence over this quotation.

9) All materials & plantings are billed as delivered or installed.

10) Terms of payment: 50% DOWN AT PROJECT START, WITH THE REMAINDER DUE UPON RECEIPT OF INVOICES.

11) Interest at 1 1/2% per month is charged on all accounts 30 days past due from date of invoice and calculated at .05% daily thereafter.
